By accessing and using CreatrMate ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our AI-powered YouTube upload assistant service that operates through WhatsApp messaging. The Service is provided by CreatrMate ("we," "us," or "our").

2. Description of Service

CreatrMate is an AI-powered service that allows users to upload, schedule, and manage YouTube videos through WhatsApp messaging. Our service includes:

• Video upload processing via WhatsApp
• AI-generated titles, descriptions, and tags
• Automated video scheduling and publishing
• YouTube channel integration and management
• Content optimization recommendations

3. User Accounts and Registration

To use our Service, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have a valid WhatsApp account
• Own or have authorization to manage the YouTube channel you connect
• Provide accurate and complete information during registration
• Maintain the security of your account credentials

4. User Responsibilities and Conduct

Content Responsibility

You are solely responsible for:

• All content you upload, including videos, images, and text
• Ensuring your content complies with YouTube's Community Guidelines and Terms of Service
• Obtaining necessary rights, licenses, and permissions for your content
• Compliance with applicable laws and regulations

Prohibited Uses

You agree not to use the Service to:

• Upload illegal, harmful, threatening, abusive, or defamatory content
• Violate any intellectual property rights
• Spam, harass, or engage in fraudulent activities
• Attempt to gain unauthorized access to our systems
• Use the Service for any commercial purpose without our written consent
• Upload content that violates YouTube's policies or any applicable laws

5. YouTube Integration

Our Service integrates with YouTube through official APIs. By using our Service:

• You grant us permission to access your YouTube channel on your behalf
• You acknowledge that YouTube's Terms of Service also apply to your use of our Service
• You understand that changes to YouTube's API or policies may affect our Service

6. AI-Generated Content

Our Service uses artificial intelligence to generate titles, descriptions, tags, and other content enhancements. You acknowledge that:

• AI-generated content is provided as suggestions and may require review
• You are responsible for reviewing and approving all AI-generated content
• We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated content
• You retain full responsibility for all published content, including AI-generated elements

7. Intellectual Property Rights

You retain ownership of all content you upload. By using our Service, you grant us a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing our Service.

The CreatrMate service, including our software, algorithms, and AI models, is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our Service.

8. Payment and Billing

If you subscribe to a paid plan:

• Fees are charged in advance on a recurring basis
• All fees are non-refundable unless otherwise stated
• We may change our pricing with 30 days' notice
• You are responsible for all taxes associated with your use of the Service
• Failure to pay may result in suspension or termination of your account

9. Service Availability and Modifications

We strive to provide reliable service, but we do not guarantee:

• Uninterrupted or error-free service
• Compatibility with all devices or platforms
• Availability of specific features at all times

We reserve the right to modify, suspend, or discontinue any part of our Service with or without notice.

10. Limitation of Liability

To the maximum extent permitted by law, CreatrMate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Damages resulting from YouTube policy violations
• Issues arising from AI-generated content
• Service interruptions or technical failures
• Third-party actions or content

11. Indemnification

You agree to indemnify and hold harmless CreatrMate, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

Either party may terminate this agreement at any time:

• You may stop using the Service and delete your account
• We may suspend or terminate your account for violations of these Terms
• We may discontinue the Service with reasonable notice

Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of Gurgaon, Haryana.

14. Google OAuth Access & API Scope Usage

In order to provide core functionality, CreatrMate uses Google OAuth 2.0 to request the following YouTube Data API scopes:

• https://www.googleapis.com/auth/youtube.upload – to upload videos to your channel
• https://www.googleapis.com/auth/youtube.readonly – to fetch channel name and confirm upload status

These scopes are authorized by you explicitly via Google's OAuth flow. The data accessed through these scopes is only used to carry out the requested upload or channel identification functions and is never shared, stored unnecessarily, or used for advertising or analytics.

You may revoke API access at any time from your Google Account permissions page: https://myaccount.google.com/permissions.

15. WhatsApp Messaging

By interacting with CreatrMate through WhatsApp, you agree that we may receive and respond to your messages via the WhatsApp Business Cloud API. We only process messages you voluntarily send to us, and we do not collect or store unnecessary data beyond what's required to fulfill your request.

All communication via WhatsApp is subject to Meta's WhatsApp Business Policy. You are responsible for any content you send via WhatsApp and agree not to use our WhatsApp channel for unlawful or inappropriate activities.

16. Data Deletion

You may request deletion of your data at any time by sending the phrase "Delete my data" to our WhatsApp number or contacting us at legal@creatrmate.com. Upon verifying your identity, we will delete your chat history, uploaded content, and associated metadata within 7 business days unless retention is required by law or for legitimate service operations.

This deletion policy applies to data shared through WhatsApp as well as any associated YouTube content processed via our platform.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
